More Regulation, Please, ATA Sues to Get DOT to Issue HOS Regs
One of the dreaded pieces of red tape for truck drivers and trucking companies alike are hours-of-service regulations. Congress passed a law in 1994 requiring the Department of Transportation to specify the standards for supporting documents for hours-of-service, but the federal DOT has yet to have done so. They have unofficial standards in place but no firm regulations on the issue. The American Trucking Association has filed a lawsuit in the District of Columbia appeals circuit court to try and force the DOT to make those regulations. The ATA has filed what is called a mandamus action, in which a court can force an agency to do its job under law; since the law was passed 15 years ago and the DOT has yet to craft formal regulations on the issue, the ATA seems to be on solid footing to go to court on this issue. One possible outcome would be the use of electronic methods of tracking how many hours a driver is behind the wheel; that would make paperwork a lot easier and a lot harder to fudge, even if it has a Big Brother feel to it for many people. Business doesn’t like uncertainty, and getting some closure on the HOS standards would make life easier for both drivers and trucking service companies. The Teamsters might be against increasing the maximum hours that drivers can work in a day (a proposed regulation from 2003 moving the hours from 10 to 11 a day is still in the taking stage), but this is a regulation that both parties could agree on.
